Who got the insurance money?

I've often wondered what happened to the insurance policy Declan took out on Frank with William Brady as the beneficiary.

Obviously, if Bobby had killed his brother, the policy would have been null and void. But he didn't.

There is no William Brady to inherit - but as Frank's only relative (assuming Donny wasn't eligible) surely Bobby should have inherited the money? But would he have wanted to touch what he must have seen as blood money, even though his financial situation was so dire?



Does anyone know the answer to the actuarial problem? Should we get his penpal on to it?

I incorporated the insurance policy into one of my EPs. in 'THEIR STORY.' and Bobby after some soul-seaching excepted the money.

Since Declan (stupidly and fraudulently) made the beneficiary William Brady, not Robert Goren, and William Brady was dead, the policy would be null and void - at least, the insurance company I worked for many moons ago wouldn't have paid out on it; not in 10 million years!

Ah, but William Brady wasn't dead, he never existed. The money SHOULD have gone to next-of-kin, methinks.

Good point - I was getting my 'Brady's' mixed up! :0)
However, if the beneficiary was named as 'William Brady', there's no way they'd pay it out to someone called 'Robert Goren' - not in my day anyway (but that was a long, LONG time ago)

It's a toughie, Diane. I don't think it's usual to name a beneficiary on an insurance policy in the UK. I had to have my burial insurance assigned to my mum, and remove that when she died, but if I hadn't done so, it would still have paid out to my estate. Don't know about the US.

Sorry, that was me (spelling errors) Taking out insurance on someone who doesn't exist is fraud. They wouldn't pay out on a fraudulent policy.

Ah, but therein lies the other conundrum, Tess. The policy was on Frank, who was real. So in theory it's a legitimate policy and should pay out...to someone. The problem is, in the eternal absence of the non-existent Brady, to whom?

But Declan took out the policy with a fraudulent name...So I'm pretty sure it's still fraud.

My uncle sold life insurance for 75 years! Too bad he's not around to ask.

From my limited experience with inusrance policies, since the policy was made out on Frank and Frank was murdered not by Declan but by "what's her face". The policy would in fact be valid. As for who took out the policy it really doesn't matter what name Declan used (Mikey Mouse is a common name). What would happen would then be dictated by the intestate laws of NY. Which means that an estate would be established and the money would be divided by any exsisting relatives or spouses. So its possbile that after a number of years, Bobby would have a chunck of change coming his way.
